MINUTES
TOWN OF SEBAGO
SPECIAL BOARD OF SELECTMEN’S MEETING
7:00 p.m.
TUESDAY, MAY 2,, 2006

I       Call to Order
        The meeting was called to order at 7:00 p.m. by interim Chairman, Jeff Harriman.
                
II      Roll Call
Present were Selectmen; Jeff Harriman, Bob Irish Jr., Dave McCarthy, Town Manager; David Hague, and Recorders Michele Bukoveckas and Nancy LaPointe.  Selectmen, Allen Crabtree and Ruth Douglas were absent.  Guests present were: Public Works Director; Ted Shane, Transfer Station Supervisor; David Crawford, Ted Harriman, Jerry Holt, Don Allen, Mike LaPointe, Abe Parker, Mike Borsetti, Jason Schoolcraft, Phil Strike, Jason Greene, Jeff Wallace, Christine Barbour, George Sampson, Don Olden Sr. Alan Greene, Ned and Carol Woodman, Linda & Kevin Sheehan, Claudia Flynn, Norman Storey and Robert Kennedy.
                
III     Adjustments to the Agenda
Bob Irish Jr. made a motion to make Item 10 an Executive Session pursuant to Title 1 M.R.S.A. § 405 (6) (A) to discuss a  personnel matter, and make item XI Adjournment.  It was seconded by Dave McCarthy.  Motion carried.
        
IV      Next Board of Selectmen’s Meeting is scheduled for :  May 16, 2006

V       Comments from the Public        
Jason Schoolcraft asked questions regarding his concern about public funds being used for private use.  The public was assured that the actions were in the best interest of the Town and that no laws were broken.

VI      Written Communication
A.      Approval of the April 18, 2006 Selectmen’s Meeting Minutes
        Dave McCarthy made a motion to approve the April 18, 2006 Selectmen’s Meeting Minutes.  It was seconded by Bob Irish Jr.  Motion carried.

B.      Approval of the April 24, 2006 Selectmen’s Meeting Minutes
        Dave McCarthy made a motion to approve the April 24, 2006 Selectmen’s Meeting Minutes.  It was seconded by Bob Irish Jr.  Motion carried.

C.      Approval of Warrants # 42 & # 43
        Bob Irish Jr. made a motion approve Warrants # 42 and # 43.  It was seconded by Dave McCarthy.  Motion carried.






D.      Signing of Town Meeting Warrant
        Dave McCarthy made a motion to sign the Town Meeting Warrant with the following edits:
ü       Article 14: add that copies of the Comprehensive Plan are available in the Town Office.
ü       Article 16: for two equal payments.
ü       Article 18: change the article to allow the treasurer to transfer funds within the authorized budget to cover overdrafts.
ü       Article 22: delete the dollar amount and add services
It was seconded by Bob Irish Jr.  Motion carried.

VII     Old Business
A.      Discuss Road Standards Order 02-06
        Dave McCarthy made a motion to discuss.  It was seconded by Bob Irish Jr.  See the following edits:

An Order to Establish Standards for Plowing Public Easement Roads.

BE IT ORDERED BY THE BOARD OF SELECTMEN OF THE TOWN OF SEBAGO, MAINE:

That the following standards for plowing public easement roads are hereby adopted;  that for the Town to consider plowing public easement roads, owners of the roads must adhere to these standards; and that the Public Works Director/Road Commissioner will inspect public easement roads for compliance with maintenance standards each year before winter August 1 of each year and report his findings and recommendations to the Board of Selectmen.

1.      At the very least, public easement roadways must maintain their current width and include an area for winging back snow banks.  Roads accepted as Public Easements after Town Meeting of 2006 must meet town road specifications.

2.      Public easement roadways must have a properly maintained surface (i.e., smoothly graded or paved) and must be free of trees, shrubs, branches, rocks and other obstructions that may damage or impede plowing vehicles.

3.      Public easement road surfaces must be adequate to support heavy plowing vehicles.  Muddy or soft roads cannot be plowed.

4.      A turning area adequate for large plow vehicles must be provided.  This area must allow for snow storage and turning and maneuvering the area as to not cause damage.  This area cannot include driveways.

5.      Public easement roadways must have a minimum of two permitted residences.

6.      Public easement roadways must be free of trees, shrubs, branches, rocks and other obstructions that may damage or impede plowing vehicles.
7.      Property owners and/or road association(s) must grant an acknowledgement of a public easement and grant an easement deed to the Town.
                                        
VIII    New Business
        There was none.

IX      Reports from Town Officials & Committees
A.      Town Manager
        David Hague reported the following:
ü       Town Hall steps will be completed by Town Meeting
ü       Would like to close the Town Office on May 18, 2006 for website training and June 30, 2006 to close the books.
ü       Run an ad about the Universal Waste Day scheduled for June 10th and 11th.
ü       Will be advertising for a new Public Works Director.  Ted Shane is leaving his position after 6 years.  Thank you Ted!

B.      Selectmen
        Dave McCarthy inquired about the two vehicles at the Public Works Garage.  He was informed they were going to be used for extricating exercises by the Fire Department.

C.      Department Heads
        There were none.

D.      Committees
                        There were none.

X       Executive Session  pursuant to Title 1 M.R.S.A. § 405 (6) (A) to discuss a  personnel matter

Bob Irish Jr. made a motion to enter into Executive Session  pursuant to Title 1 M.R.S.A. § 405 (6) (A) to discuss a  personnel matter at 8:03 p.m..  It was seconded by Dave McCarthy.  Motion carried.

Dave McCarthy made a motion to reconvene at 8:44 p.m.  It was seconded by Bob Irish Jr.  Motion carried.

There was no action taken during Executive Session.

XI      Adjournment
        Bob Irish Jr. made a motion to adjourn at 8:47 p.m.  It was seconded by David McCarthy.  Motion carried.
