Board of Selectmen Minutes 09/20/2016


CALL TO ORDER
The meeting was called to order by Vice Chairman, Tim Mayberry at 5:58 pm.

  • ROLL CALL
Present were Selectmen; Tim Mayberry, Chris Parker, Edythe Harnden, Phil Lowe, Town Manager; Jim Smith, Town Clerk and Recorder, Michele Bukoveckas.  Guests present were: Fire Chief; Ken Littlefield, Ted Greene, Jason Schoolcraft, Phil Strike, Linda and Jim Panzera, Gracie Edwards, Beth Grant, Town Attorney; Tim Murphy, Camp O AT KA representative; Kyle Tong, their attorney; Sarah Beard, and State Senator; Jim Hamper.

Item B under New Business will be discussed first on the agenda.

III.    WRITTEN COMMUNICATION

                A.      Approval of the September 6, 2016 Selectmen’s Meeting                                         Minutes
Phil Lowe stated that under his comments, it was stated that Jim Smith would seek a representative to speak to the Board concerning the Japanese Knot Weed, not him.  He also stated that he did not recommend a committee be formed to review our ordinances.  Edythe Harnden made a motion to approve the minutes as amended by Phil Lowe.  It was seconded by Phil Lowe.  Motion carried.

IV.     COMMENTS FROM THE PUBLIC
        There were none.


VII.    NEW BUSINESS:   

                B:       DISCUSSION WITH FIRE CHIEF-INNER ISLAND FIRE
Phil Lowe stated he had received a phone call from Camp Mataponi concerning a fire on Inner Island.  Half the island is in Naples, half in Sebago.  The caller stated that the fire call was not well coordinated and that there were several issues that needed to be addressed such as communication and equipment. This fire was an illegal burn. The Fire Chief stated that Naples had their pumps, but due to weather conditions and circling boats, the buoy pumps bobbed, causing them to fail.  Bridgton which also responded was able to use a larger pump which helped fight the fire. Questions were raised as to whether or not there was adequate equipment in the department to fight island fires. Ken Littlefield said that equipment is just part of the problem, it doesn’t matter how much equipment you have if you don’t have the staff to use it.  Regarding communication, it was stated that there are areas in town where radios and cell phones just don’t work.  The Fire Chief said that resident Jim Panzera, was an asset, as he used his personal boat to bring fire fighters and equipment out to the fire.  The Board would like Town Manager; Jim Smith to write a letter of thanks to Jim Panzera.

V.      EXECUTIVE SESSION, PURSUANT TO TITLE 1 § SECTION 405 (6) (E), TO CONSIDER TAX EXEMPTION, AND POTENTIAL LITIGATION, REGARDING CAMP O AT KA.”
Tim Mayberry made a motion to enter into Executive Session, Pursuant To Title 1 § Section 405 (6) (E), To Consider Tax Exemption, And Potential Litigation, Regarding Camp O At Ka.” At 6:23 pm.  It was seconded by Phil Lowe.  Motion carried.

The Board reconvened at 6:48 pm. No action was taken during Executive Session.

VI.     OLD BUSINESS
        There was none.

VII.    NEW BUSINESS
  • Camp O AT KA Exemption Discussion
Sarah Beard stated that the Camp is entitled to this exemption per statue and definition.  She told the Board the Camp has a charitable purpose by helping young boys become men.

Phil Lowe asked “What percent of the operational costs is represented by tuition”?  Kyle Tong responded about 80-82%.  

Tim Mayberry stated that this was a difficult decision to make.  By granting the exemption, the Camp was asking the rest of the town to subsidize them. He stated as a Board Member, his job is to represent all.  He stated that the Board are not experts in interpreting the law and they would rather be told they are wrong and grant the exemption later. The Board expressed their gratitude to Camp O AT KA for all they due for the town, but this is a different issue.  Tim Mayberry made a motion to deny the exemption status application for Camp O AT KA.  It was seconded by Chris Parker.  Motion carried.

  • Discussion with Fire Chief: Inner Island Fire
Previously discussed.

  • Signing of Quit Claim Deeds (Edwards)   
Phil Lowe made a motion to have the Town Manager execute the quit claim deeds for Gracie Edwards.  It was seconded by Tim Mayberry.  Motion carried.  Jim Smith signed the quit claim deeds and they were handed to Gracie Edwards.  Gracie was made aware that she was responsible for recording the deeds at the registry of deeds.   
                                

VIII.   REPORTS FROM TOWN OFFICALS
                
  • Town Manager
Jim Smith commented/reported on the following:
  • Has looked into having Public Works certified to spray pesticides.  Tim Mayberry felt the Town should hire a professional in the spring.  Phil Lowe stated he would like someone to come speak to the Board on controlling and fighting the plant.  Jim Smith will look into having someone come to a future Board meeting.
  • Was approached by residents Joan Morford and Neal Snow.  They would like to donate their time in doing trail maintenance on Douglas Mountain.
  • Selectmen
Phil Lowe commented/reported on the following:
  • Has had conversation with the Code Enforcement Officer concerning inconsistencies and concerns with some of our building and land use ordinances.  He stated that he would be willing to work with him to develop language that would address these issues.  
Edythe Harnden commented/reported on the following:
  • Inquired if the fence in the Peabody Pond Cemetery had been fixed.  Jim Smith will look into whether or not it had been fixed.
  • Stated that the brush in the Haley Cemetery had not been picked up.  Jim Smith stated it would be this week.
Inquired what happened to the proposed Mileage Reimbursement Policy that had been presented.  It was stated that it would be on the next agenda.

                C.      Committees
  • Withdrawal Committee
Tim Mayberry stated that he will give a report at the next Selectmen’s Meeting.  He stated that a meeting is scheduled for 7pm on September 29th at Sebago Elementary.

IX.     ADJOURNMENT
Tim Mayberry made a motion to adjourn at 7:40pm.  It was seconded by Phil Lowe.  Motion carried.
