Planning Board Minutes 11/08/2016

I       Call to Order

Chairman Paul White called the meeting to order at 7:00 p.m.  

Present: Donna Cook, Jim Jansz, Joe McMahon, Tina Vanasse, Paul White, Code Enforcement Officer Brandon Woolley, Recorder Maureen Scanlon.

Guests present: Chris Lees, Kathy Douglass, Ed Douglass, Miranda Walker, Jason Jordan, George Sawyer (from Sawyer Engineering & Surveying, Inc.), Michael Sorrento, Ann Farley

II      Public Hearing #1 – Subdivision Plan Review – Logan Woods Subdivision (Property owned by Evelyn Jordan & Jason Jordan)

        George Sawyer reviewed the details of this proposed project for those present.  There were no questions from the audience.  

        Paul White closed the Public Hearing at 7:08 p.m.

III     Public Hearing #2 – Subdivision Plan Review – Division of Property Located on Route 114 (Property owned by Bluestone Capital, LLC)

        George Sawyer reviewed the details of this proposed project for those present.  He answered questions from the audience and clarified some of the details as requested.

        Paul White closed the Public Hearing at 7:31 p.m.

IV      Correspondence

        Maureen Scanlon advised the Board that Tina Vanasse who was absent from the last meeting held on September 13, 2016 has reviewed the minutes from that meeting and listened to the recording of the proceedings.  She has completed the “Member’s Affidavit Regarding Missed Planning Board Meetings” attesting to this fact and will therefore be allowed to participate in the approval process for both of tonight’s agenda items.  The original copy of this affidavit will be filed in the official Planning Board Meeting Minutes file.  Copies will also be filed in the Planning Board files for both of these proposed projects.    

The schedule of Planning Board Meeting Dates for 2017 was distributed to the Planning Board members at the start of this meeting.

V       Open to Public Questions

        No questions were asked.

VI      Review of Minutes (September 13, 2016)
           (NOTE: No meeting was held in October.)

Joe McMahon made a motion to approve the minutes from September 13, 2016 as presented.  It was seconded by Donna Cook.  Motion carried with all in favor.

VII     Old Business    

  • Subdivision Plan Review – Logan Woods Subdivision

Paul White explained that there do not seem to be any issues that would not allow the approval of this previously approved project with the proposed change of splitting the larger existing house lot of nine (9) acres into two smaller lots; one that will be seven (7) acres and another that will be (2) acres.  

In regards to the driveway issue that was previously brought up it was noted that according to the town’s ordinance, the 10% Completion Rule does not apply to this project’s common driveway because it is not considered a road.  This rule applies to the construction of roadways.  Brandon Woolley pointed out that the declaration for the original approval was very clear in stating that any driveway construction cost is to be shared by the purchasers of the lots, it was not encumbered on the developer to construct the driveways.  This also makes the aforementioned rule inapplicable.  There was further discussion regarding the fact that since this subdivision is located off of a State Road the applicant would be required to provide proof of a valid (active) Department of Transportation (DOT) permit for the driveway before being able to obtain a building permit from the Code Enforcement Officer.     

For future clarification purposes Joe McMahon made a motion that the two year time limit is not required for construction of the driveway.  It was seconded by Jim Jansz.  Paul White asked if there was any further discussion on the matter before taking the final vote.      

Brandon Woolley mentioned that this is only going to be a driveway and therefore is not required to be brought up to the town’s road standards.  It only has to be a 15 foot roadway but on paper it has got to be a 30 foot right-of-way.  Paul White stated that the 10% Rule’s two year time limit does not apply to the construction of a driveway.  

Motion carried with all in favor.

Joe McMahon made a motion to approve the project.  It was seconded by Tina Vanasse.  Motion carried with all in favor.  

Maureen Scanlon confirmed that all fees have been paid to date including the fees for tonight’s Public Hearing.

It was noted that before the Board members sign off their approval on the Mylars the correction will be made to reflect the 30 foot right-of-way at the existing driveway entrance.

  • Subdivision Plan Review – Division of Property Located on Route 114 (Property owned by Bluestone Capital, LLC)                                          Map 9, Lot 21
The Department of Transportation (DOT) approval for lot 6B has not been received yet for this project.  George Sawyer stated that at the next meeting he will have the road profile which will identify the grades and the aforementioned driveway permit for the Board’s review.   

Maureen Scanlon confirmed that all fees have been paid to date including the fees for tonight’s Public Hearing.
This project will be added to the agenda for the December 13, 2016 meeting.
